Several years ago, I had an acquaintance who wanted to start a business
customizing Happy Birthday messages for delivery over the phone. In an attempt
to secure legal rights to do so, he was advised that the song was under
copyright and that the owners were not willing to grant a license. So if you
want to start a business that relies on the use of this song, you would at the
very least be taking a big chance, since, as you say, it "might" be public
domain. It also might not.

If I remember correctly, that would be Michael Jackson, through one of
his publishing acquisitions. Maybe your friend should try again. MJ
might need some bail money.
