Legal issues and live recording. (not a pirating thread)

I like to go out to live venues and record friend's bands as a
hobby. I'm always invited to come along to record. I'm wondering if
I'm ever going to get into trouble one day for doing this.
If it's a venue that charges a fee if a recording is made there, you
could get in trouble with the venue if they don't know you're coming
and if they don't get their fee. There was a thread here a few weeks
back about this practice and there are good and silly reasons why
those who charge a fee do it.
Am I
considered a member of the band in these cases? Do I need some sort of
permit or insurance? What happens if I run into a union confrontation?
I suppose they could break your kneecaps and your own medical
insurance should cover that. I doubt that it would make any difference
if you were a member of the band or not. Are these bands just a bunch
of your friends, or are they big time stuff with a manager who comes
to the gigs (and should be taking care of details of recording), or
all of the above?
So far everyone has been cool with me and my mics. However I always
worry about the whole thing crashing down on everyone but the drunken
idiot that would have knocked it over. Somebody could lose an eye and
I'd be in a heap of trouble.
Yes, that could happen. Best to see that it doesn't happen. At some
point, you probably should think about liability insurance. You can
bet that if someone gets hurt and wants to make a fuss, even if it's
just tripping over one of your mic cables, they're going to sue the
band, the venue, and you.
