Default Creative Labs owes you $62

Apparently, their Audigy and Extigy soundcards don't actually do 24-bit,
96kHz audio in most circumstances....

...old news. This kind of situation goes back to the Live! series.

http://www.theinquirer.net/?article=22019

As I read this article, the only way to actually get the $62 is to
take it as a 25% discount on something worth $248 from their company
store web site. Most of their products run around $100, so the typical
discount is more like $25.

The prices at their company store website are not necessarily the
lowest around, so the purported savings might be illusory.

Bottom line the biggest possible winner is the lawyer who filed the
suit. He only got about half a $mil, and even thaty is slim pickings
in this kind of lottery.

Wow, I'm glad I bought a Creative Labs Audio PCI 128-bit PCI Sound Card.
It sounds so much better than those old fashioned 24 bit ones, and only
cost $10.

Out of interest, I wonder what circumstances it does do 24bit 96k?
Perhaps with the two channel ASIO drivers?
I wish they put a big warning label on the old Soundblaster Lives too,
saying 'This card will only work properly at 48k'. It would have saved
many people a lot of wasted time.

That subject got my attention, but disappointingly, not only does
it not apply to me, it doesn't apply to anyone.

Some pertinent quotes and comments:

"Creative claimed that the products in question could handle 24-bit
audio at 96Khz – indeed this was stated on the product boxes in bold
letters, and in all advertising. But complaints filed in 2003 pointed
out that this was only true in a very limited set of circumstances,
and pretty much all of the audio passing through the cards would
actually be processed at lower quality."

I interpret this to mean the card will play 24/96 files, but the
actual analog output will be the same quality as the card playing a
16/44 file (which, IIRC, gets converted to 48 before going to the
D/A).
Likewise (my further interpretation) when recording, the card will
generate 24 bits at a 96k rate, with some of those bits actually
having some sort of relation to the audio.

"The difference probably wouldn't concern the average gamer or casual
MP3 enthusiast, but many of those planning to use the Creative cards
for professional-quality audio were outraged by the labelling."

No crap, OTOH anyone who knew SB's reputation wouldn't be
surprised.

"Creative did not admit liability, but graciously agreed to settle the
embarrasing case. Anyone, anywhere* who purchased one of these
products before the end of 2004, and is unhappy with the audio
processing, will be able to get 25 per cent off the cost of their next
purchase from Creative's website, up to a limit of $62.50.

Hurry, this great offer ends September 25, 2005.

....

** IN NORTH OR South America only, apparently."

So no one who bought these cards actually GETS any money (except
the original complaintants and especially their lawyers, as stated in
parts I didn't quote), Creative is just offering this as a
credit/discount on the purchase of MORE of Creative's cr.., er,
products.

But you have to like this writer's sarcasm... "this great offer"
.... snickering out loud...

Cheers,
Trevor de Clercq

With the "we'll give you 25% off of next purchase" instead of a refund it
seems that Creative is actually being rewarded for their bad behavior.

Which makes class actions useless, they're all like that anymore. I
never respond to those anymore, although opting out of the class is
probably more sensible.

If you really read it, it's more like an ad than a news item. "Hurry, the
great offer ends September 25, 2005."

Ugh, I feel more ripped off than ever now. I hate my Audigy Platinum so
much, that a swore never to buy another Creative product as long as I
live. WTF am I gonna do with %25 off?
