In America, in a legal context, it is. But I agree that in the context
of mass murder, it wouldn't be unless it's a pogrom to exterminate

George is spot-on here. In America, the Supreme Court ruled that
"freedom of religion" could be extended to "freedom from religion", so
atheism has the legal protection of a religion without actually being
one.
