Most states have no prohibition on wearing headsets while driving.

I will not say whether I drove or not but cranking your stereo or
spending a fortune to deaden your car, truck or bus is just as bad I
think. ???
Anyway, I purchased this MP3 player and a set of some ear buds on the
*cheap* and had an enjoyable and stress less ride to Seattle and back.
The buds (3 pairs of different sizes) cancel out just about everything
to begin with and the MP3 player as bad as MP3s can sound, sounded
pretty darn good. Just don't use the headphones that the player comes with.
$36.38 total shipped free to my door and the body shop wanted a fortune.

That might be legal in the USA, but here in the UK, *anything* like
earbuds which interferes with your hearing in both ears is totally
banned while driving. A single earpiece is fine, though. Having seen a
lot of near misses where a pedestrian or cyclist hasn't heard the bus
(Or lorry or car) or its horn, and just walked or ridden across the
road, being missed only by the grace of God and the driver's skill, I
think using them should be banned outside buildings.
Having said that, being deaf does not necessarily disqualify you from
getting a driving licence here.

I walk 3 miles every day and when I am not on the phone and have my ear
buds in it can get mighty dangerous not hearing cars and such. I
usually stick to the trails and then get these fast bikes and big dogs
passing me by without warning.
This MP3 player however also makes a good digital recorder with no
audible hiss or noise and is especially good for crude recording needs.
You can quickly record a melody or lyric into it before you forget it.
One can also use it to record long winded lectures that Ethan Winer,
Mike Rivers or Scott Dorsey might give, or use it to record important
speakerphone conversations with Comcast, Verizon, or even UK Utilities. ;-)

I'm not saying they don't have their uses, just pointing out the
dangers. And in the case of Ethan's and Scott's lectures, the danger of
getting too absorbed.....
