I took a look at eBay's rules as you suggested, and there are two
problems with your statement above. The first problem is that eBay
doesn't even mention the term "usenet" any where in their rules, at
least their search function says something to the effect that no
information is available on "usenet". They do however have a lot of
rules relating to "spam" on other venues, which assuming the anti "spam"
rules apply to "usenet", raises the interesting question of what the
formal definition of "spam" might be? One man's "spam" is often another
man's treasure, in the case of "usenet" it appears that people are prone
to call most any post they don't like "spam".

Exactly, an ad for a private person selling something he owns, used
to a group that does not allow any ads at all is not spam, it's abuse.
Now that said the charter as quoted does not forbid ads. Commercial ads
to Usenet are abuse anyway whether the charter says so or not unless the
group is for that, ie: rec.audio.marketplace. In the groups I attend it
is generally accepted that an individual can offer something for sale,
though as a general rule it's not something that happens all the time.
If it does happen and you are selling stuff every week, you've crossed
the line into more commercial than private. That is generally decided by
the regular member of whichever group. If the people of a group want all
ads banned from that group, they should officially ad that to the
charter/FAQs and said document needs to be posted regularly to the
group. I might also note that it takes more than two complaints to
action any account, even an eBay account.
